Liability Waiver and Release of Claims

By participating in the Relativity Robotics Challenge (the “Competition”),
you (the “Participant”) acknowledge and accept the terms of this Liability Waiver and Release of Claims.
This document clarifies the allocation of responsibilities and risks associated with voluntary participation
in a robotics competition organised by the Relativity Team – the robotics team of
Liceul Teoretic de Informatică „Alexandru Marghiloman” Buzău (the “Organiser”),
with hosting and technical infrastructure provided by EssenByte Solutions (the “Technical Provider”).
Article 1 – Acknowledgement of Risks
- The Participant understands that designing, building and operating robots involves inherent risks, including but not limited to mechanical failure, electrical shock, fire, collisions, or personal injury.
- The Participant voluntarily participates in the Competition, fully aware of these risks, and assumes full responsibility for any resulting harm, except where damage is caused by the Organiser’s or Technical Provider’s intentional misconduct or gross negligence.
Article 2 – Release and Indemnity
- To the maximum extent permitted by law, the Participant releases and holds harmless the Relativity Team, EssenByte Solutions, and their directors, employees, volunteers, contractors, and partners (collectively, the “Released Parties”) from any and all claims, liabilities, damages or expenses arising from participation in the Competition, including personal injury or property loss.
- This release does not extend to damage or injury caused by the Released Parties’ intentional acts or gross negligence. Under Article 1355 of the Romanian Civil Code, liability for such acts cannot be excluded or waived.
- The Participant agrees to indemnify and defend the Released Parties against any third-party claims arising from their own actions or omissions during the Competition.
Article 3 – Equipment and Personal Property
- The Participant is solely responsible for the design, transport, and maintenance of their robot and personal equipment. The Organiser and Technical Provider are not responsible for loss, theft, or damage to Participant property.
- All robots must meet the Competition’s technical and safety requirements. Failure to comply or to pass inspection may result in disqualification.
Article 4 – Safety Compliance
- Participants must follow all safety instructions and comply with the Technical Safety Declaration, Official Competition Rules, and applicable laws.
- Under Law 319/2006, all participants must act to ensure their own safety and that of others, cooperate in risk prevention, and immediately report any hazards or incidents to event officials.
Article 5 – Governing Law and Jurisdiction
- This Waiver is governed by Romanian law. Any disputes shall be submitted to the competent courts of Buzău, Romania.
By signing or electronically accepting this Liability Waiver, the Participant confirms that they have read,
understood, and agreed to these terms, and that participation is voluntary and at their own risk.
